These Terms of Service ("Terms") govern your use of the Presence macOS application (the "App") and the website stayspresent.com (the "Site"), provided by Trine Point LLC ("Trine Point," "we," "us"). By downloading, purchasing, or using Presence, you agree to these Terms.
Subject to these Terms and your active plan, Trine Point grants you a personal, non-exclusive, non-transferable license to install and use Presence on the number of devices permitted by your plan. Presence is licensed, not sold.
You may not: (a) copy, redistribute, resell, or sublicense the App; (b) reverse engineer, decompile, or disassemble it, except to the extent that restriction is prohibited by applicable law; (c) remove or alter any proprietary notices; or (d) share your license key beyond your permitted device count.
Presence is a utility that prevents your Mac from going idle or to sleep. You are solely responsible for ensuring that your use of Presence complies with all applicable laws and with the policies of your employer or any organization whose systems or accounts you use. You use Presence at your own discretion and risk.
Purchases and subscriptions are sold and processed by Lemon Squeezy as Merchant of Record. Monthly and annual plans renew automatically at the then-current price until cancelled. A lifetime plan is a single, one-time payment. All prices are in U.S. dollars unless stated otherwise and are exclusive of any taxes that Lemon Squeezy may collect.
You may cancel a subscription at any time; access continues through the end of the paid period, and cancellation stops future renewals. Refunds are handled by Lemon Squeezy in accordance with their policy. If you believe you are entitled to a refund, contact info@trinepoint.com.
We may release updates, and your plan includes updates as described at the time of purchase. We may modify, add, or discontinue features over time.
Presence is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that it will achieve any particular result.
To the maximum extent permitted by law, Trine Point LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of Presence. Our total liability for any claim will not exceed the amount you paid for Presence in the twelve months before the claim.
We may suspend or terminate your license if you materially breach these Terms. On termination, you must stop using and delete the App.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules.
We may update these Terms from time to time; the "Last updated" date will change accordingly. Your continued use of Presence after an update constitutes acceptance of the revised Terms.
